Rep. Davis Files Legislation to Mandate Informed Parental Consent on Psychotropic Medications

YORKVILLE – State Representative Jed Davis has filed legislation to ensure parents have the final say when it comes to their kids being prescribed psychotropic medications.

“Parents – not bureaucrats – should be making medical decisions for their kids,” said Rep. Davis. “Informed consent is critical, especially when we’re talking about powerful medications with potentially serious, life-altering side effects.”

House Bill 2512 ensures:

  • Doctors must provide printed FDA Medication Guides to parents before prescribing psychotropic drugs to kids.
  • Parents must give written, informed consent before any prescription is issued.
  • A new online system allowing parents to report adverse drug reactions, increasing accountability and transparency.
  • Noncompliance will come with penalties, including potential Medicaid reimbursement suspensions for providers and financial consequences for the Department if reporting requirements are missed.
  • The Department of Healthcare and Family Services must compile quarterly reports on adverse drug reactions and submit them to the legislature.

Rep. Davis added, “This bill is about protecting kids, preventing government negligence, and ensuring parents are fully informed. While these medications can be beneficial, they also come with risks. Parents deserve to know the facts and make the best decision for their child – without interference.”
